Luna Web Studio Terms of Use

1. Introduction & Scope of Services

These Terms of Use (“Terms”) govern your access to and use of all products and services provided by Luna Web Studio, including our website, web applications, SaaS platforms (such as CodeDash), and any related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

2. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will provide notice of material changes, and continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

3. Privacy Policy

Please review our Privacy Policy to understand our practices regarding personal information collection, use, and disclosure.

4. Copyright & Intellectual Property

All content made available through the Services, excluding user-generated content, is the property of Luna Web Studio or its licensors and is protected by copyright and other intellectual property laws.

Unauthorized reproduction, distribution, or modification of our content is prohibited.

5. Account Creation & Responsibilities

To use certain features of the Services, you may be required to create an account. You agree to:

  • Provide accurate, complete, and current information.
  • Maintain the confidentiality of your login credentials.
  • Accept full responsibility for all activity under your account.

Age Requirement: You must be at least 13 years old (or 16 in the EU/UK) to create an account. If you are under 18, you represent that you have consent from a parent or legal guardian.

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Subscriptions & Payments (CodeDash)

  • Subscription Model: CodeDash operates on a monthly subscription basis.
  • Payments: All payments are processed securely through Stripe.
  • No Refunds: Subscriptions are non-refundable, except as required by law.
  • Auto-Renewal: Unless canceled, subscriptions automatically renew at the end of each billing cycle.

You may cancel at any time, but you will remain responsible for charges through the end of the current billing cycle.

7. User Content & Ownership

You retain ownership of any content you create or upload to the Services (“User Content”). However, by using the Services, you grant Luna Web Studio a non-exclusive, worldwide, royalty-free license to host, display, distribute, and otherwise use User Content as necessary to provide the Services.

Additionally, Luna Web Studio reserves the right to showcase User Content publicly (e.g., in marketing materials, examples, or showcases), unless you explicitly opt out in writing.

Prohibited Content

You may not upload, post, or distribute any User Content that:

  • Contains pornography or sexually explicit material.
  • Promotes violence, hatred, or harassment.
  • Infringes on intellectual property rights.
  • Involves fraud, scams, or phishing attempts.
  • Contains viruses, malware, or harmful code.

Violation of these rules may result in immediate removal of content and suspension or termination of your account.

8. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes.
  • Reverse engineer, decompile, or attempt to access source code.
  • Interfere with, disrupt, or overload our systems.
  • Scrape or harvest data without permission.
  • Engage in fraudulent, deceptive, or phishing activities, including attempts to obtain sensitive information from other users.

The Services may contain links to third-party websites. Luna Web Studio is not responsible for the content, products, or services provided by these third parties.

10. Service Availability & Modifications

We may modify, suspend, or discontinue any part of the Services at any time without liability. While we aim for reliability, we do not guarantee uninterrupted access or availability.

11. Disclaimer of Warranties

The Services are provided “as is”, without warranties of any kind, express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law, Luna Web Studio and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or use, arising from or related to your use of the Services.

13. Indemnification

You agree to indemnify and hold harmless Luna Web Studio, its affiliates, officers, employees, and agents from any claims, damages, or expenses resulting from your violation of these Terms or your use of the Services.

14. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in New York, NY, in accordance with the rules of the American Arbitration Association.

Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive any right to participate in class or collective actions.

15. Children’s Privacy (COPPA)

The Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will delete it immediately.

16. Applicable Law

These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law principles.
